Who we are and who can use Kindwork

Kindwork (“Kindwork”, “we”, “us”) is operated by a California sole proprietorship. By creating an account or otherwise using Kindwork, you agree to these terms and to our Privacy policy. If you don’t agree, don’t use Kindwork.

You must be at least 18 and able to enter a contract, and you must use Kindwork for work in the United States.

The service

Kindwork reads the Gmail and Google Calendar you connect and sorts your mail with real-estate labels. Each morning it drafts replies and notes for you. Nothing is sent until you approve it, and what you approve is sent from your own email address. Texting is optional.

Kindwork is new, and we will keep changing it. Some features may be marked as early, and any feature may change. If we take away something material that you pay for, we will tell you before it happens.

Your responsibilities

• You read and approve each message, and you are responsible for every message you approve and for what it says.
• You follow your brokerage’s policies and the laws that apply to your own messages, including CAN-SPAM and the Telephone Consumer Protection Act.
• You use Kindwork with your own contacts. No purchased or rented lists, and no spam.
• You have the right to use the contact information in your account.

AI-written drafts

Kindwork’s drafts are written by an AI model. A draft can be wrong or out of date, so read each one before you approve it. Once you approve a message, it is yours.

Your account and access

Keep your login secure, and tell us at once if you think someone else has used it. You are responsible for anyone you let use your account.

You can remove Kindwork’s access to Google at any time from your Google Account, which stops Kindwork reading or sending your mail.

Fees

Kindwork is a paid subscription, at the price shown when you subscribe. Payment runs through Stripe. We will tell you before any change to your price takes effect.

You can cancel at any time. Cancelling stops the next charge, and Kindwork keeps working until the end of the period you have paid for. Before your account closes, you can export your data.

Texting from Kindwork

If you switch texting on, Kindwork texts you your daily list and approval requests. The terms for texts from Kindwork are at getkindwork.com/sms-terms and are part of these terms.

Your data and our property

Your mail and your contacts stay yours. You give us permission to process them only to provide Kindwork to you, as the Privacy policy describes.

Kindwork’s software and brand belong to us, and these terms do not transfer them to you. While your subscription is active, you may use Kindwork for your business.

Other services

Kindwork depends on services we don’t control: Google for your mail and calendar, Twilio for texts, Stripe for payment, and Microsoft once Outlook is supported. Their own terms apply to your use of them, and their outages can affect Kindwork.

Disclaimers

Kindwork is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We make no promise of any business result, such as replies, referrals, listings or closed deals. Nothing Kindwork writes is legal, financial, tax or other professional advice.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business, lost goodwill or lost data. Our total liability for any claim about Kindwork is limited to what you paid us for Kindwork in the twelve months before the event that led to the claim. Some places do not allow these limits, so parts of this section may not apply to you.

Indemnity

You agree to cover our losses and reasonable legal costs from claims that arise out of the messages you approve, the contacts and data you provide, your breach of these terms, or your breach of any law.

Governing law and disputes

These terms are governed by the laws of the State of California and by United States federal law. The state and federal courts in California hold jurisdiction over any dispute, unless we agree in writing on another way to resolve it. Before bringing a claim, please write to us so we can try to settle it informally.

Changes to these terms

If we change these terms, we will update the date at the top. For a material change, we will tell account holders by email before it takes effect. Using Kindwork after that means you accept the new terms.

The done-for-you service

Existing clients of our done-for-you service keep their current arrangement until they move to the Kindwork product. Where a client has an arrangement agreed in writing, including its fees and any commitment made at the time, that arrangement controls over these terms.
